ISLAMABAD: It has been decided by the Prime Minister of Pakistan Mr Nawaz Sharif that Pakistan Army has to be deployed in all major cities of Pakistan under article 245. The decision was taken in order to assist civil institutions by the Armed Forces.
According to details, the Prime Minister took this decision while holding a high-level meeting in Islamabad today (Friday) whereas he also discussed the situation of Internally Displaced persons (IDPs) who have been affected by the operation Zarb-i-Azb and left their homes.
In accordance with the Article 245, 650 [(1)] 650, the Federal Government can call and direct the Armed Forces to defend Pakistan against external threats of war or aggression and subject to law, assist or act in aid of civil power.
No court can ask question to the Federal Government under clause (1), 651 [(2) if the Federal Government issues any valid direction.
(3) no jurisdiction under article 199 can be exercised by A High Court against the areas in which Pakistan Armed Forces are deployed and assisting the civil power for the time being in pursuance of the Article 245:
On the condition that the jurisdiction of the High Court shall not be deemed to affect with this clause in respect of any proceeding which is pending immediately before the day on which the Armed Forces start assisting the civil power.
(4) If any proceeding concerning an area referred to in clause (3) instituted on or after the day the Armed Forces start assisting the civil power and pending in any High Court will remain suspended during the time period till the Armed Forces are deployed and acting or assisting the civil power.
